I, PAUL KURTZ, University Professor of 700 East Amherst St. Buffalo, New York 14215-1674, hereby make oath and say as follows:

1. I am the manager of the First Defendants, a corporate body registered in the United States, and make this affidavit on its behalf.
2. The only part of the First Defendant took in the publication and distribution of "Physics and Psychics" was to receive it from the Fourth Defendant, edit the manuscript, and arrange for its publication and distribution in the United Kingdom with the Second Defendants pursuant to an arrangement so to do.
3. Prior to publication, neither I nor anyone employed by the First Defendants were aware that there were any errors in "Physics and Psychics" and I never knew that it contained the words complained of until I heard from the solicitors for the Plaintiff.
4. I now understand that it is untrue that the Plaintiff was ever arrested in Israel and I unreservedly apologise to him both on behalf of myself and the First Defendants.

5. I and the First Defendants hereby undertake to take no steps further to publish or distribute the said book in the United Kingdom so long as it contains the words complained of. Indeed, neither I nor the First Defendants have taken any such steps since the error was pointed out to me.
6. This affidavit is made pursuant to Section 4 of the Defamation Act of 1952.
